Information on the processing of users’ personal data by WMA S.r.l.

In this privacy statement, you will find all relevant information that relates to our use of your personal data. Pursuant to articles 13 and 14 of Regulation 2016/679/EU (hereinafter “GDPR”) we will process your personal data collected in compliance with the rules of the GDPR and other relevant Italian regulations (Legislative Decree 196/2003 and Legislative Decree 101/ 2018) in order to guarantee the rights, fundamental freedoms, as well as the dignity of natural persons, with particular reference to privacy and personal identity.

 

WHO WE ARE

The Data Controller of your data is WMA S.r.l., VAT number 02596970463 in the person of its pro tempore legal representative, with registered office in Via B. Lupi 14, 50129 Florence, Italy.

 

IF YOU PROVIDE US THIRD PARTY DATA

If you provide/communicate personal data of third parties to us, you act as independent data controller and assume the consequent legal obligations and responsibilities, relieving WMA S.r.l. with respect to any objection, claim and/or request for compensation for damage from treatment that may come from the aforementioned third parties.

 

WHAT ARE THE TYPES OF DATA WE PROCESS

The data that you decide to provide/communicate to us can be of two types:
1. PERSONAL DATA: any information relating to an identified or identifiable natural person, such as a name, an address, an identification number, location data, an online identifier;
2. SPECIAL DATA: those data which, being particularly sensitive, deserve greater protection, such as, for example, data relating to the physical or mental health of a natural person which reveal information relating to their state of health.

 

WHY WE TREAT YOUR DATA

The means by which you can interact with us are as follows:
– our BruxApp Research Cloud app, i.e. the mobile app you installed on your device.
– our Bruxapp Dashboard.
The legal basis for the processing of your personal data lies in some cases in the fulfillment of contractual or legal obligations. For example, we need to process your personal data when you download our app.
In other cases, the legal basis of the processing is the consent that you can provide in relation to the processing of data relating to your health, or to obtain information. Or to enable us to carry out scientific research.

 

FOR WHICH PURPOSES WE USE YOUR DATA

The processing of your personal data is carried out by the Data Controller in order to provide you with information, to proceed with the stipulation of the contract, or to carry out scientific research activities.
In the following table, you will find in detail the individual purposes for which the data will be processed and the time in which we will keep them:

The provision of your data for the aforementioned purposes is optional, but any failure to provide the data and the refusal to provide them would make it impossible for the Data Controller to stipulate and/or execute the contract and provide the services/services requested.

We may also process your personal data after the times indicated above to assert or protect our rights or to implement obligations deriving from the applicable pro tempore regulatory and regulatory framework.

 

TO WHOM WE COMMUNICATE YOUR DATA

We may communicate your data to third parties such as suppliers of services strictly necessary for the performance of the Controller’s activity (e.g. system administrators), or to company consultants (e.g. accountants, lawyers) where this proves necessary for fiscal, administrative, legal, contractual reasons or for needs protected by current regulations or to doctors in execution of the requested service. In some cases, subject to your consent, we may communicate your data to university bodies/institutes for the purpose of scientific research on bruxism. In this case, however, your data would previously be
anonymised.
We will only transmit the data necessary for the activities requested of them.
We will never disclose your personal data, i.e. we will not make your data known to unspecified subjects (in any form, including by making them available or consulting them).
We do not transfer your personal data to international organizations and/or non-EU countries.
Our obligation remains to communicate the data to Public Authorities upon specific request.

 

HOW WE TREAT YOUR DATA

We process your data lawfully and fairly for the purposes indicated above.
We process your personal data using manual, IT and telematic tools with logic strictly related to the purposes themselves and, in any case, in order to guarantee their security and confidentiality.

 

YOUR RIGHTS

As an interested party, you have the right to request confirmation as to whether or not your personal data is being processed and access your personal data.

You also have the right to request rectification, cancellation, notification of corrections and cancellations to those to whom the data may have been transmitted by us, limitation of processing, portability of personal data, to oppose the processing of your data.

Finally, you have the right to oppose decisions that concern you if they are based solely on automated processing of your data, including profiling.

In the event that you believe that the treatments concerning you violate the rules of the GDPR, you have the right to lodge a complaint with the Guarantor pursuant to art. 77 of the GDPR.
